1. Introduction
Welcome to MixMaster Pro (the "Service"), a product owned and operated by Ming GF Ltd ("Company", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your use of our website and the MixMaster Pro service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
2. User Accounts
When you create an account with MixMaster Pro, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
3. Subscriptions
Some parts of the MixMaster Pro Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis. Subscriptions automatically renew under the exact same conditions unless you cancel it or Ming GF Ltd cancels it.
4. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Ming GF Ltd and its licensors. The "MixMaster Pro" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Ming GF Ltd. You must not use such marks without the prior written permission of the Company. You retain full ownership of the audio files you upload, and we claim no intellectual property rights over the material you provide to the Service.
5. Audio Content Privacy
Your uploaded audio files are treated with the utmost confidentiality. Ming GF Ltd uses your audio content solely for the purpose of providing analysis and feedback services. We do not use your audio content for training our AI models or any other purpose without your explicit consent.
Access Control: Only you and Ming GF Ltd have access to your uploaded audio files. We do not share, sell, distribute, or provide access to your audio content to any third parties, affiliates, or external services. Your music remains private and is never made publicly available.
Data Security: We implement industry-standard security measures to protect your audio files from unauthorized access, disclosure, or breach. All audio uploads are encrypted and stored securely on our servers.
Personal Mentor Chat: For Studio plan subscribers, our personal mentor chat feature provides personalized mixing guidance. Chat messages are stored securely for 90 days from the date of creation to maintain conversation history. After 90 days, messages are automatically deleted from our servers. This retention period allows you to reference previous conversations while ensuring your data privacy over time.
6. User Content and Responsibility
You are solely responsible for all audio files, data, and content ("User Content") that you upload to the Service. By uploading User Content, you represent that you have the necessary rights, licenses, and permissions to do so.
MixMaster Pro is an analysis tool. Uploading a track to the Service does not grant you ownership or copyright if you are not the rightful owner. Ming GF Ltd does not verify copyright ownership of uploaded files. We are not responsible or liable for any copyright infringement claims arising from the content you choose to upload and analyze.
Our responsibility is limited to maintaining the privacy and security of your uploaded content as described in our Audio Content Privacy policy. We are not responsible for any offensive or unlawful comments or files you may post on the platform.
7. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
8. Limitation of Liability
In no event shall Ming GF Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Your relationship with Ming GF Ltd is governed by these Terms and the laws of the United Kingdom.
10. Changes to These Terms
Ming GF Ltd reserves the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect.
